1. The challenge of finding new income for the owners' association: preconditions for making your façade or scaffolding profitable.

To begin with a statement as a compass: "when faced with excessive expenses, you must either cut them or look for new sources of income".

You live in a Community of Property Owners (hereinafter CP) very visible from or located in: 

- A busy intersection

- Areas that despite not being central are either monumental or business districts. 

- Large communication hubs (airports, highways or ports).

High visibility is the key that opens the option to negotiate a contract that allows the installation of an advertising banner on the facade of the CP or on a scaffolding superimposed on it.

2. How to sign such a contract?

a) The articles of association of the CP must be revised: if the rules of the CP may prohibit advertisements, then they must be modified. To do so, according to the Catalan law 5/2015 a qualified majority is required, i.e. 4/5 parts of the Board.

Uniform facades are also requested in the CP's. In view of this, it will be better that the advertising canvases cover the whole building. 

b) The Owners' Meeting must approve the installation of the tarpaulin: the favorable vote of 4/5 parts of the owners with voting rights will be required, however, "unanimity will be necessary when the rental of the space deprives the enjoyment of a common area of the building (the roof for example)," as explained by consumer.es.

c) The President of the community - with the advice of the Property Manager - must negotiate the future contract which will specify: period of exploitation, conditions and price. Consumer.es recommends that: "the CP should demand from the advertiser an insurance against third parties that covers it against damages that could be caused by the support commissioned by the advertiser".

d) The president must sign a collaboration agreement with the interested company to rent part of the facade of the building or to place advertising on the scaffolding.

3. Access to information from the Administration on the placement of tarpaulins, legal and safety aspects 

The time has come to contact the public authorities.

The first thing to have clear is: Which is the competent Administration to regulate the advertising tarpaulins in the cities? The local one.

Below we give you access to the e-mail and the two web addresses of the Barcelona City Council to request information on the installation of advertising on buildings:

As we have already said in the first point: visibility is the key attribute of the advertising canvas. For this reason, the Barcelona City Council considers the installation of advertising as a "landscape impact" this type of impact is associated with an economic compensation.

The legislator also warns that: "the advertising use will always be limited in time. The same landscape impact will require: "express authorization" from the Administration to host advertising outdoors. The consistory may also require: the building permit or the municipal license that is legally appropriate".

It should be noted that a "responsible declaration" regarding the safety of the advertising installation is attached to the common use form.

In light of this fact, Finques Feliu and Certicalia consider it essential to "request a technical project by a technical architect to check three safety aspects of the advertising installation:

- The solidity of the structure

- The installation surface 

 - The support that will hold the billboard"

4. Epilogue: Sponsorship in sport

We are talking about the only basketball team that has won three European Cups in a row.  Toni Kukoc played there, the owner of a record that is less and less possible to equal: 3 European Cups in a row and 3 NBA rings in a row (he played with Michael Jordan and Scottie Pippen).

In soccer the first sponsorship to the elite was that of Entracht Braunschweig, which in 1973 carved the logo of the liquor brand Jägermeister.  The German Football Federation refused, but the president of that club, decided to change the shield... Because it coincided with the logo of the famous liqueur (a deer).
