The purpose of this Privacy Policy is to provide information on the rights of both Users and Visitors under the General Data Protection Regulation ("GDPR") and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

At FINQUES FELIU we want to be transparent and inform you about the processing we carry out with your data and the purposes for which we process the aforementioned data.

3. Analysis, segmentation and profiling of clients and users:

8. Internal investigations:

Manage complaints or internal investigations due to violation by the interested party of internal regulations, which implies the management of the file and consultation with the areas that are necessary for this.

FELIU collects data such as name and surname, date of birth, DNI/NIE, address, bank account, email, IP address, mobile and landline, intention to sell and/or purchase and any other data that you choose to provide through the use of the telephone and/or email and/or our user area, information and documentation about the property, date of birth, gender, marital status, image of your identity document and any other information that you decide to provide us.

We can also record the telephone calls we make with you.

The data provided to us by third parties, as long as there is a cause that legitimizes the aforementioned communication of data, informing you at all times of the origin of your data.

We collect your data that you provide us directly through the form on our website, by telephone, at FELIU physical stores or through our sales representatives.

We also collect your data through third parties, such as group companies and other collaborators in the real estate sector. When the data is provided by third parties, as long as there is a cause that legitimizes the aforementioned data communication, we will inform you about the origin of your data.

We inform you that we retain your personal data for the entire duration of the contractual relationship or for a longer period if you authorize us to do so. Likewise, we inform you that your data will remain blocked for the attention of judicial, administrative or fiscal claims and in compliance with money laundering legislation, for the periods legally determined by each applicable regulation.

We will also consider whether and how we can reduce the personal data we use over time, and whether we can anonymize your personal data so that it can no longer be associated with or identified with you, and in this case we may use the information without notice.

FELIU will process your data based on the following legitimacy:

1. The pre-contractual and contractual relationship.

The legal basis for the processing of your data is the execution of the contract or the application of pre-contractual measures in order to process and manage your request. Likewise, we may communicate your data to companies in the Housfy Group when necessary to execute the contractual relationship.

Both the offer of products and services and the transfer of data to third parties in the real estate services, property management and ancillary services sectors, including the companies of the Housfy Group, to which FINQUES FELIU belongs, and to the marketing services sector, for the purpose of sending you commercial communications and information solely and exclusively about real estate, property management and ancillary products, are based on the consent expressly requested by ticking the box on the website form. Withdrawing this consent will in no case affect the performance of the contract. Consents may be withdrawn at any time by sending an email to dpo@feliu.es.
2. The creation of profiles with the purpose of offering you products and designing promotions and commercial and advertising communications to be sent electronically (newsletters, SMS, etc.) according to your tastes and preferences based on the results of the analysis, segmentation and profiling actions of clients and users.

3. Legitimate interest:

1. Sending commercial communications as long as there is a legitimate interest in products and services of companies of the Housfy Group with commercial activity, transferees of the personal data given their status as a real estate services group, as they are analogous to the contracts for the client. The legitimate basis of legitimate interest is to maintain the relationship with the client by registering new products, improving the conditions of the products and/or services that have been contracted and offering information about similar products and/or services that may be interesting for the client, which allows the data controller to continue with its economic activity and grow within its sector.
2. Conducting surveys: Verify the quality of communications, the procedures of the data controller, the treatment received by the user, as well as FELIU products and services. Improve user service procedures and update the catalog of products and services, understanding the way in which the user interacts with FELIU, as well as detecting their degree of satisfaction.

4. Processing of data of representatives and contact persons: Identify the people who represent the client or who intervene as contact for the purposes of contracting. This treatment is only applicable in the event that the client is a legal entity.

Your personal data may be communicated to third parties when the communication is necessary for the correct provision of their services, including:

• Housfy Group entities for internal administrative and commercial purposes.
• Judges and Courts, Public Finance, Government and Public Administration Organizations, State Security Forces and Bodies, etc. when there is a legal obligation.
• Data processors with whom FELIU has signed the corresponding data processor contracts that include the appropriate guarantees.

International transfers of your personal data may be made to FELIU service providers. These providers may be located in states outside the European Economic Area. When it has not been declared that they have a level of protection equivalent to the European one, FELIU will adopt the corresponding standard contractual clauses.

FELIU contracts its virtual infrastructure according to a Cloud Computing model through Amazon Web Services (AWS) whose servers are located within the European Economic Area.

Data processors located in the United States and other countries outside the European Union, necessary for the execution of the assignment contract:

• WhatsApp Inc. (USA), under the Standard Contractual Clauses for data protection adopted by the European Commission.
• Iterable Inc. (instant messaging service), hosted in the United States, under the Standard Contractual Clauses for data protection adopted by the European Commission.
• Microsoft Corporation (USA), under the Standard Contractual Clauses for data protection adopted by the European Commission.
• Esendex, for sending SMS, whose data is hosted in the United Kingdom, a country offering an equivalent level of protection under the Commission Decision of 28 June 2021.

Companies that provide us with commercial services in marketing, fraud and money-laundering prevention, real estate, valuation, photography and architecture will have access to your data.

We may receive information about you from third parties providing technical, payment and delivery services, advertising networks, analytics providers, and search providers when they offer services to us.

From software providers that offer an analytics solution that can record: Screens visited, Interaction patterns (such as screen actions, gestures: taps, scrolls), and Device details (Type, Version, Model, Operating System). We use the information collected by these providers to improve our service.

These providers store and process this information on our behalf and it may contain personally identifiable information, although we proactively delete it when possible.

In any other case in which you have consented to reveal your data to us.

FELIU, with the aim of making this Privacy Policy effective and efficient, has adopted the technical and organizational security measures required by current legislation on the protection of personal data.

All necessary means and mechanisms have been established to prevent alteration, loss, misuse, unauthorized treatment and access or theft, taking into account the state of technology. However, you must bear in mind that Internet measures, due to their nature and global nature, are not impregnable.

The data protection regulations grant interested parties the possibility of exercising a series of rights that allow them to guarantee and protect in a real and effective way their right to honor and personal and family privacy.

In the event that, in the course of a relationship with us, you provide us with personal data from third parties, we remind you that you are solely responsible for having obtained your prior consent to communicate the personal data to FELIU for the purpose of informing you in each case, as well as for having informed you of the content of this Policy.

It is responsible for holding all Housfy Group companies harmless from any liability arising from the lack of information and/or consent to the third party.

You are responsible for each of the personal data that you provide us, as well as its veracity, inaccuracy, updating, validity and authenticity, including your consent for it to be used and/or processed.

Likewise, you are responsible for the data of third parties that you provide us and for which you are obliged to obtain their consent once you have transferred the privacy information provided in that specific case to FELIU, given that we do not have direct contact with that third party. And don't forget that you are responsible for regularly reviewing this Policy and its updates.

We inform you that you may exercise the following rights:

1. Right of access to your personal data to know which data is being processed and the processing operations carried out with them;

Right to the portability of their data, the right of the interested party to receive personal data that concerns them, that they have provided to FELIU, in a structured, commonly used and machine-readable format, and to transmit them to another controller without being prevented by the controller to whom they have been provided, as long as the conditions established in article 20 of the General Data Protection Regulation are met.
